Fatality case resolution sought in death of Linda Davey

Lawyers try to avoid trial of man charged in crash that killed city mom and injured her son

Crown and defence lawyers are in talks to resolve the case of a Calgary motorist charged with killing a city mom and injuring her wheelchair-bound son.

Defence counsel Steve Wojick appeared briefly in Court of Queen's Bench yesterday to ask that his client's case be adjourned to Nov. 30, when it could be settled without a trial.

"I anticipate, sir, having some resolution discussions with the Crown and advancing the case on that date," Wojick told Justice Bryan Mahoney.

Outside court, Wojick would not elaborate on what might happen, but a resolution would mean a guilty plea to either some, or all of the charges the accused faces, or lesser included crimes.

Wojick's client, Darren Coupal, 38, faces several charges in connection with the traffic death of city mom Linda Davey and injuries sustained by the dead woman's son, Josh, and neighbour Fakhria Zadran.

Davey, 43, Josh, then 15, who suffers from cerebral palsy and is confined to a wheelchair, and Zadran were walking near their Bridlewood homes April 30, 2008, when they were struck by a motorist who then fled.

The most serious charge Coupal faces is impaired driving causing death which carries a maximum punishment of life in prison.

In July 2008, Wojick entered not guilty pleas on behalf of his client to 11 criminal charges and set a trial date of this past July 20, which he later converted to a preliminary inquiry

Coupal was released on bail with strict conditions which included house arrest and a complete abstention from consuming alcohol eight days after the fatal crash.

He remains at liberty pending the conclusion of his case.
