Court: Brian McIvor loses appeal in crash fatality of Katherine Chorney

BRITISH COLUMBIA -
A Campbell River man has lost his case in the B.C. Court of Appeal on a conviction of dangerous driving causing death following an Oct. 24, 2007, car crash on Saltspring Island.

Brian Marland McIvor had shared three bottles of wine with a friend before he got behind the wheel of a pickup and drove in excess of the 60 km/h speed limit on winding Saltspring roads.
McIvor's vehicle failed to slow for a curve and he braked too late.

The pickup spun into oncoming traffic, killing nurse Katherine Chorney.

The trial judge convicted McIvor, saying that he failed to confine his vehicle to his own lane of traffic.

McIvor was sentenced to a year in jail.

McIvor has had numerous criminal driving offences, including failing to stop at the scene of an accident, two convictions for being over the legal blood-alcohol limit and impaired driving.

Three appeal court justices agreed with the lower court and dismissed McIvor's appeal.
